Welcome to Pattx! These Terms of Service ("Terms") govern your access to and use of Pattx's pattern generation platform, websites, APIs, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using our Services, you confirm that:

• You are at least 16 years of age
• You have the legal capacity to enter into these Terms
• You agree to comply with all applicable laws and regulations
• You have read and understood our Privacy Policy

If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Services

Pattx provides:

• Pattern Generation: Tools to create seamless patterns, backgrounds, and textures
• Pattern Library: Access to pre-made patterns and templates
• API Access: Programmatic pattern generation for developers
• Export Tools: Download patterns in various formats (SVG, PNG, CSS, etc.)
• Collaboration Features: Workspaces for teams (on applicable plans)

3. Accounts and Registration

3.1 Account Creation

To access certain features, you must create an account by providing:

• A valid email address
• A secure password
• Accurate profile information

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your credentials
• All activities under your account
• Notifying us immediately of unauthorized access

We are not liable for losses resulting from unauthorized account access.

3.3 Account Termination

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent activity
• Abuse our Services
• Fail to pay applicable fees

4. Subscriptions and Payments

4.1 Plans

We offer:

• Free Plan: Limited pattern generation and features
• Pro Plan: Enhanced features, higher limits, priority support
• Team Plan: Collaboration features, shared workspaces
• Enterprise: Custom solutions for large organizations

4.2 Billing

• Subscriptions are billed in advance on a monthly or annual basis
• Prices are in USD unless otherwise stated
• Taxes may apply based on your location
• Failed payments may result in service suspension

4.3 Refunds

• Monthly plans: No refunds for partial months
• Annual plans: Pro-rated refunds within the first 14 days
• Credits: Non-refundable unless required by law

4.4 Plan Changes

• Upgrades take effect immediately
• Downgrades take effect at the next billing cycle
• Unused features are forfeited upon downgrade

5. Intellectual Property

5.1 Our Content

Pattx and its licensors own:

• The platform, software, and technology
• Pre-made patterns in our library
• Trademarks, logos, and branding
• Documentation and tutorials

5.2 Your Content

You retain ownership of:

• Custom patterns you create
• Images and assets you upload
• Your brand materials

By using our Services, you grant us a license to:

• Store and process your content
• Display your content to you
• Generate patterns based on your inputs
• Improve our Services using anonymized data

5.3 Pattern Usage Rights

Free Plan Users:

• Personal and commercial use of generated patterns
• Attribution appreciated but not required
• No resale of raw pattern files

Paid Plan Users:

• Full commercial rights to generated patterns
• No attribution required
• May include in products for sale
• May use in client work

5.4 Prohibited Uses

You may not:

• Claim ownership of pre-made library patterns
• Resell our platform or API access
• Use patterns in competing pattern services
• Remove watermarks or copyright notices

6. Acceptable Use

6.1 You Agree To

• Use Services only for lawful purposes
• Respect intellectual property rights
• Maintain accurate account information
• Report security vulnerabilities responsibly

6.2 You Agree Not To

• Reverse engineer our software
• Attempt to access other users' accounts
• Overwhelm our systems with automated requests
• Upload malicious content or malware
• Harass, abuse, or harm others
• Violate any applicable laws
• Circumvent usage limits or restrictions

6.3 Content Restrictions

You may not create or upload patterns that:

• Infringe on others' intellectual property
• Contain illegal or harmful content
• Promote violence or discrimination
• Include personal information of others without consent

7. API Terms

If you access our API:

7.1 API Usage

• Respect rate limits for your plan
• Do not share API keys
• Include proper attribution where required
• Cache responses when appropriate

7.2 API Changes

• We may update the API with notice
• Breaking changes will be communicated in advance
• Deprecated features will have a transition period

8. Disclaimers

8.1 Service Availability

Our Services are provided "as is" and "as available." We do not guarantee:

• Uninterrupted or error-free service
• That patterns will meet your specific requirements
• The accuracy or reliability of any content

8.2 Third-Party Services

We integrate with third-party services (payment processors, cloud providers). We are not responsible for their availability or actions.

9. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to amounts paid by you in the past 12 months
• We are not liable for loss of data, profits, or business opportunities

10. Indemnification

You agree to indemnify and hold harmless Pattx, its officers, directors, employees, and agents from any claims, losses, or damages arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any third-party rights
• Content you create or upload

11. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes by:

• Email notification
• In-app notice
• Website announcement

Continued use after changes constitutes acceptance of the new Terms.

12. Termination

12.1 By You

You may terminate your account at any time by:

• Deleting your account in settings
• Contacting support

12.2 By Us

We may terminate or suspend your account for:

• Terms violations
• Extended inactivity
• Business reasons (with notice)

12.3 Effect of Termination

Upon termination:

• Your right to use Services ends immediately
• You may export your content before termination
• We may delete your data after 30 days
• Outstanding payments remain due

13. Dispute Resolution

13.1 Informal Resolution

Before filing a claim, you agree to contact us and attempt to resolve the dispute informally for at least 30 days.

13.2 Arbitration

Any unresolved disputes will be settled by binding arbitration, except for claims that may be brought in small claims court.

13.3 Class Action Waiver

You waive the right to participate in class actions or class arbitrations.

These Terms are governed by the laws of Delaware, USA, without regard to conflict of law principles.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pattx.

14.2 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

14.3 Waiver

Failure to enforce any provision does not constitute a waiver of that provision.

14.4 Assignment

You may not assign your rights under these Terms. We may assign our rights to any successor.

14.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond our control.
